These terms are an agreement between you and Brouz Hyperlocal Services Private Limited (“Inkwis”, “we”, “us”) for the use of inkwis.com, app.inkwis.com and related services (the “Service”). By creating an account or joining a session you accept them. If you use Inkwis on behalf of an organization, you confirm you may accept these terms for it.
1. Accounts
- You must be at least 18 to create an account. Students under 18 may join live sessions as guests at the invitation of their teacher or institution.
- Give accurate information, keep your password safe, and tell us at once if you suspect someone else has used your account.
- You are responsible for what happens in your account and on boards you own, including what you allow participants to do in your sessions.
2. Your content
- You own what you create and upload. You give us permission to host, copy, transmit and display it only as needed to run the Service for you and the people you share it with (for example, to sync your board, record a session or answer an AI request you make).
- You confirm you have the rights to the content you upload, including permission from people who appear in it.
- We don’t use your content to train AI models or for advertising.
- You can delete your content and your account at any time. Retention after deletion is described in our privacy policy.
3. AI features
AI answers, summaries and quizzes are generated automatically and can be wrong or incomplete. Review them before relying on them or sharing them with students. AI features run only when you ask and are subject to your plan’s daily limits.
4. Plans and payment
- Free: the canvas with no time limit, plus 6 hours of live sessions in total (up to 30 participants, recording and replay included), 10 AI requests a day, and replays kept for 45 days. When the 6 hours are used, new live sessions and recordings need a paid plan; nothing already created is deleted.
- Paid plans are billed monthly in advance through Razorpay at the prices on our pricing page, which exclude GST. Where GST applies, it is added and shown before you pay.
- Upgrades take effect immediately and are charged pro rata. Downgrades and cancellations take effect at the end of the current billing period. See cancellation and refunds.
- If a payment fails, we retry for 7 days. If it still fails, your account moves to the Free plan; your content is kept.
- We may change prices or plan limits. We will tell you at least 30 days before a price change affects your subscription, and you may cancel before it applies.
5. Acceptable use
You agree to follow our acceptable use policy. We may remove content or suspend accounts that break it, and we will tell you why unless the law or safety prevents it.
6. Availability and changes
We work to keep the Service available and your data safe, but we provide it “as is” and do not promise it will be uninterrupted or error-free. We may change or discontinue features; if we discontinue the Service, we will give at least 30 days’ notice so you can export your content.
7. Liability
To the extent the law allows, we are not liable for indirect or consequential losses, lost profits or lost data, and our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law.
8. Suspension and termination
You may stop using the Service and delete your account at any time. We may suspend or close an account that breaks these terms, puts others at risk, or is required to be closed by law. On closure, your content is deleted as described in the privacy policy.
9. Organizations and schools
If your organization has a separate agreement with us (including a data processing agreement), that agreement takes precedence over these terms where they differ.
10. Governing law and disputes
These terms are governed by the laws of India. Courts at Chennai, Tamil Nadu, have exclusive jurisdiction. Before going to court, write to us at support@inkwis.com and we will try to resolve the issue within 30 days.
11. Changes to these terms
We will notify account holders of material changes at least 30 days before they apply. Continuing to use the Service after that means you accept the new terms.
